Federal Judge Mandates Release of Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The case stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling allegations, he was held in immigration custody.
In her decision, the judge noted that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
Background of the Legal Challenge
The court proceedings involve conflicting assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in Tennessee.
Conditions of Release
The judge, who was overseeing his challenge to deportation in a Maryland district court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
This decision represents a notable development in a complex immigration battle involving claims of wrongful detention and contested gang affiliations.
